As the breach was admitted we find the charge proved.

Accordingly after taking all the above facts into account we impose a suspension on Mr Hutchings from riding in races which is to start after racing on 26 May and conclude after racing on 31 May 2012 (4 days). This deferred penalty comes under the provisions of rule 1106(2).

Facts:
Following race 2 an information was filed pursuant to rule 638(1)(d). The informant Mr J Oatham alleged that Mr R Hutchings rider of DORIAN GREY permitted his mount to shift out near the 200 metres when not clear of BRONDAN (Mr A Forbes) which was checked.
Submissions for Decision:
Mr Williamson demonstrated the video films which showed DORIAN GREY racing against the rail approaching the 200 metres. It then became evident shortly after this point that Mr Hutchings allowed his mount to start drifting out and into the line of BRONDAN. Mr Williamson said DORIAN GREY was only half a length clear of BRONDAN at this stage which caused crowding to this runner and his rider Mr Forbes having to take a hold.
Mr Hutchings said he was looking for better ground but admitted he went too far. He said his mount was having only its second start and was still very green.
Mrs Rogerson had nothing to say when asked.

Mr Oatham told the committee that Mr Hutchings had incurred 4 suspensions in the last 12 months which for the number of rides he has was not a bad record. He submitted today's charge was at the lower end of carelessness.
Mr Hutchings said he had commitments up to and including 6 May 2012.
Reasons for Penalty:
The committee carefully considered all submissions and evidence. In Mr Hutchings' favour are his admission of the breach and his reasonably good record. However on this occasion Mr Hutchings made the mistake of continuing to ride his horse out while shifting ground. Obviously he was not the required distance clear of BRONDAN in this outward movement. The committee finds this breach to be at the lower end of carelessness.
