Facts:
Following the running of the DUNSTAN FEEDS STAYERS CHAMPIONSHIP QUALIFIER, an Information was lodged by Senior Stipendiary Steward, Mr M Williamson against Jockey, Mr O P Bosson alleging that Mr Bosson failed to make the contracted weight for GONE WEST.
Rule 330(3)(c) provides: A Rider shall not fail to ride a horse at the weight at which it is handicapped to carry.
Mr Bosson was present at the hearing and he acknowledged that he understood the Rule and that he admitted the breach.
Mr Williamson in giving evidence said that at the time of weighing out Mr Bosson could not make the correct weight and was in fact one kilo overweight.
Mr Williamson said that the Stewards tried to get a replacement rider but none were available. Mr Brown the Co-Trainer of the horse advised the Stewards that he would rather scratch it. In the end however it was agreed that Mr Bosson would ride the horse one kilo overweight. GONE WEST subsequently won the race.
Submissions for Penalty:
Mr Williamson said that this was Mr Bosson's 3rd breach in the last 4 months. There was a breach at Taupo on the 12th of August 2020 for which he received a fine of $500 and last Wednesday the 16th of December at Counties he received a $200 fine.
Mr Williamson submitted that a $500 fine was appropriate.
Mr Bosson said that he had recently had a suspension and during that time his weight had increased. He did say however, that he rode in Race 5 today at 56.5 kgs the same weight as GONE WEST and earlier had ridden in 2 Races at 57kgs. He said it was a very hot and humid day today and he had drunk some water.
Reasons for Penalty:
It is puzzling that Mr Bosson could ride at 56.5kgs in Race 5 and yet in Race 8 he was a kilo overweight. The Committee acknowledges that it has been very hot and humid today and Mr Bosson has told us that he had a drink of water. Does that explain the considerable increase in weight. We are not sure.
In any event weight is a rider's responsibility and this is Mr Bosson's 3rd breach in 4 months We take into account the mitigating features which are essentially set out above but believe that a fine of $500 is appropriate.
