Facts:
Prior to the running of race 5, Lisa Chittick Foxbridge Plate, an Information was filed pursuant to Rule 330(3)(c). The Informant, Mr Oatham, alleged that Mr Bosson failed to make the required weight for AUTHENTIC PADDY.
Mr Bosson did not attend the race meeting and he advised the Stewards that he admitted the breach and he did not wish to present at the hearing.
Rule 330(3)(c) provides: “A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.
Mr Oatham advised the Committee that Mr Williamson had spoken to Mr Bosson and he was happy for the hearing to proceed without him being present which was endorsed on the Information.
Mr Oatham said that AUTHENTIC PADDY was entered for race 5, a Group 2 race worth $100,000. He said that it was Mr Bosson’s only ride on the day and his Agent Mr Rodley contacted him at 7.45 am this morning to inform him that Mr Bosson would not be able to make the carded weight of 58.5 kgs. Mr Oatham said that Mr Colgan was the replacement rider.
Mr Oatham specified that Mr Bosson had not ridden since the beginning of June 2017 when he was stood down from riding due to ill health. He said that Mr Bosson then opted to have a breakaway from riding.
Mr Bosson offered no excuse to the Stewards as to why he failed to make the weight.
Submissions for Penalty:
Mr Oatham said that today was Mr Bosson’s 4th breach of this Rule in the last 12 months.
11 March - $100 fine – Minor Infringement
22 March - $200 fine – Minor Infringement
15 April - $350 fine – Information.
Mr Oatham recommended that for today’s breach a fine in the vicinity of $300 to $500 should be imposed. He said that Mr Bosson’s weight was an ongoing concern and it was disappointing to find that in his first ride back from a break he failed to make the weight in such an important race.
Mr Bosson did not provide the Stewards with any penalty submissions.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
The aggravating factors were as follows, this breach occurred in a Group 2 race worth $100,000 and the connections and betting public were adversely affected at late notice. In our view this charge is more serious than Mr Bosson’s previous breaches due to the fact that AUTHENTIC PADDY was carded to carry 58.5 kg’s which has previously been well within his weight range. The Committee was mindful that historically Mr Bosson has had an appalling record under this Rule.
The only mitigating fact was Mr Bosson’s admission of the breach which was inevitable given the evidence.
The Committee note that Mr Bosson rode in 2 trials at the Taupo race meeting yesterday.
After taking into account all of the above the Committee deemed that an appropriate penalty was a $500 fine.
