Waikato RC 18 July 2020 – R 9 – Chair, Mr N McCutcheon
ID: JCA16641
Code:
Thoroughbred
Meet Title:
Waikato RC - 18 July 2020
Meet Chair:
NMcCutcheon
Race Date:
2020/07/18
Race Number:
R 9
Decision:
As the Charge was admitted it was found to be proved by the Committee.
Penalty:
Mr Goindasamy’s Apprentice Jockey’s Licence was suspended from 29 July up to the close of racing on 8 August 2020.
Facts:
Following the running of Race 9 (Preferment @ Brighthill Farm 1200) Information No. A12923 was filed with the Judicial Committee. It was alleged that Mr Goindasamy the Rider of TELLYAWHAT allowed his mount to shift in over the final stages (50m) when not sufficiently clear of SPEEDY MEADY which was crowded and steadied.
Mr Goindasamy and Mr Manning said that they understood the Rule, Charge and confirmed that the breach was admitted.
All film replays were shown with Mr Williamson submitting that TELLYAWHAT shifted in over the final 3 strides crowding SPEEDY MEADY which had to be steadied to avoid heels. He submitted that TELLYAWHAT was approximately 1 length clear when shifting in. He added that it was not the worst case of interference but that it possibly cost SPEEDY MEADY from finishing 3rd.
Mr Manning said that he could not say much as he thought Mr Goindasamy was guilty.
Mr Goindasamy had nothing to say.
Submissions for Penalty:
Mr Jones said that this was now Mr Goindasamy’s 5th breach of the Rule within 12 months and said that while the carelessness was not high it possibly cost SPEEDY MEADY 3rd placing.
Mr Manning and Mr Goindasamy did not make comment.
Reasons for Penalty:
The Committee took into consideration Mr Goindasamy’s record, the admitted breach and that Mr Goindasamy did not attempt to straighten his mount’s line of running.
It is also noted that SPEEDY MEADY received relatively severe tightening. For those reasons the carelessness was placed in the mid-range category.
A 4-Riding Day suspension was adopted as a starting point, with a significant aggravating feature being that it appeared that SPEEDY MEADY would have finished 3rd but for the interference.
A discount for the admittance of the breach was not afforded, as the charge would have been sustained, due to the compelling film evidence.
After careful consideration it was deemed that a 5-Riding Day suspension was a condign penalty.
