Facts:
Following race 8 an information was filed pursuant to Rule 638 (3)(b).The Informant, Mr J Oatham alleged that Mr T Arumugam used his whip in an excessive manner when riding STERLING PRINCE.

Mr Arumugam and Mrs Hillis had nothing to say.
Submissions for Penalty:
Mr Oatham said this was Mr Arumugam first whip charge from 44 race day rides. He said Mr Arumugam was inexperienced and the breach was at the lower end but was concerned it was not a great look on the video films. He submitted a fine of $150-$200 would be appropriate.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. Mitigating factors are Mr Arumugam admission of the breach and this was his fist charge under the rule, we believe the breach is at the lower end. However his use of the whip was clearly outside the guidelines.
