As the breach was admitted we find the charge proved.

Accordingly after taking all the above into account Mr Hills is suspended from riding after racing on 24 January and concluding after racing on 28 January 2015 ( 3 days).

Facts:

Following race 4 the Foote, Beatson & Whale Ready To Runners 1400 an information was filed by the informant Mr M Williamson. He alleged that Mr Hills allowed his mount BHIWANI to shift inwards when not clear of CHARLIE FARLEY which had to steady and lose ground passing the 150 metres.

Mr McIntyre demonstrated the video films pointing out BHIWANI ridden by Mr Hills racing in a position near the lead passing the 150 metres. He showed Mr Hills allowing his mount to shift in when not clear of CHARLIE FARLEY. Mr McIntyre submitted that Mr Hills was approximately 3/4 length clear and this movement by Mr Hills caused CHARLIE FARLEY to lose ground.

Mr Hills in admitting the breach conceded he had rolled in slightly.

Submissions for Penalty:

Mr Williamson told the committee Mr Hills had an excellent record which was clear in the last 12 months.  He said in this case the interference was not great but the consequences could well have cost CHARLIE FARLEY finishing in a better place. He asked the committee to treat this as a low grade offence.

Mr Hills said he had commitments until after racing on the 24th January. He added that he intended to ride at the Ashburton meeting on the 28th January for Mr and Mrs Parsons and had already booked tickets there and back for that day.   He said he could provide evidence to the committee confirming the flights.

Reasons for Penalty:

The committee has carefully considered the evidence and submissions as presented and reviewed the video films.  When questioned further about his intention to ride at Ashburton on 28th January Mr Hills produced confirmation of airline tickets for that day on his mobile phone. This satisfied the committee Mr Hills was going to fulfil commitments on that day. We concede Mr Hills has moved in 1 horse width when only 3/4 length clear of CHARLIE FARLEY causing that horse to be steadied and lose some ground. However when the committee reviewed the films it was apparent on the head on film that CHARLIE FARLEY reacted to the whip action of Mr Jones on his inside. This accentuated the incident because CHARLIE FARLEY shied his head away from the whip.

The mitigating factors are Mr Hills' outstanding record, his admission of the breach and his level of carelessness which we assess at the very low end. Normally this breach would warrant a 4 day suspension but given the significant and unique mitigating factors outlined above and the contribution to the incident by Mr Jones' whip the committee is satisfied an appropriate penalty is one of 3 days.
