The protests fourth against first and third were dismissed, with the Judge’s placings confirmed.

The Committee authorised payment of dividends and prize money on the Judge’s placings.

Facts:

Following the running of Race 9 (Pike Punters Challenge 8 May Mile) Information A14412 was filed with the Judicial Committee. It was alleged by the Informant that first placed horse MARRONI and third placed horse GALLARDO interfered with the chances of her horse LLANACORD placed fourth by the Judge. It was alleged that the interference happened in the final straight.

Judge’s placings were:

1st-No. 5-MARRONI

2nd-No. 7-SPRING DELIGHT

3rd-No. 15-GALLARDO

4th-No. 4-LLANACORD

Submissions for Decision:

Ms Newman the Informant said that there was a clear run ahead for her; she said that MARRONI hung in for 4-5 strides and that GALLARDO rolled out. She added that when her horse was in the clear it ran home very strongly.

Mr Rogers said that LLANACORD was chopped out. He added that when in the clear LLANACORD finished strongly and made up 2.5 lengths in the last 100m.

Mr McNab said that his horse (GALLARDO) kept a straight line and that LLANACORD did not get to the gap and was not chopped out. He added that the protest was beyond him.

Mr Asano the Rider of GALLARDO said that LLANACORD could have waited for a gap on the inside. He said that his horse went straight.

Mr Innes the Rider of MARRONI said that the films showed that he kept a straight line. He added that Ms Newman was not in the gap and made it tight on herself.

Mr Baker the Trainer of MARRONI said that they had gone straight all the way.

Mr Williamson said that LLANACORD was in restricted room and that there had been a marginal shift from MARRONI and GALLARDO. He added that LLANACORD had failed to establish itself into the gap. He said that the Stewards opinion was that MARRONI and GALLARDO did not have an impact on the outcome of the race and did not support the protests.

Reasons for Decision:

The Committee considered all of the submissions and viewed the available film footage several times.

We found that any movement by MARRONI and GALLARDO did not affect the chances of LLANACORD as it had not reached the gap ahead when the marginal shifts occurred. On that basis the Committee determined that there was no interference to LLANACORD by either of the two horses protested against.
