Facts:
The Informant, Mr Williamson filed an Information pursuant to Rule 330(3)(c) alleging that Class A Rider, Mr Innes failed to make the contracted weight for his mount LONDON BOUND in race number 5, the DUNSTAN FEEDS 1200.
Mr Innes was present at the hearing and confirmed his admission of the breach and he advised that he is familiar with the nature of the charge. The Information was endorsed to that effect.
Rule 330(3)(c) provides: “A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.
Mr Williamson advised that LONDON BOUND was handicapped to carry 55 kg and Mr Innes advised Stewards prior to Race 4 that he was unable to make the carded weight due to being 1 kg overweight.
By way of explanation Mr Innes said that he was contracted to ride the horse .5 kg overweight but was .5 kg over that and therefore could not make the weight. He said that he advised LONDON BOUND'S Trainer, Mr Pike that he could not make the weight and as a result was replaced by Rider Ms D Johnson.
Submissions for Penalty:
Mr Williamson said that this is Mr Innes’ third breach of the Rule within the reset period. The previous two breaches occurred on 26/12/20 ($300 fine) and 01/01/21 ($350 fine). He said that a charge of this nature would normally be dealt with by way of a Minor Infringement Notice (MIN), however, given that it was his third breach Stewards elected to proceed by way of filing an Information.
Mr Williamson submitted the breach could be dealt by way of fine and submitted that $300 would be appropriate.
Mr Innes agreed that a fine would be an appropriate penalty.
Reasons for Penalty:
The MIN schedule establishes a $100 fine as the starting point for a first breach of this Rule. In circumstances where Stewards elect to file an Information, determination of penalties are fact dependent.
The Committee considered the submissions and noted the fines imposed for the two previous breaches. The Committee noted that Senior Rider Ms D Johnson replaced Mr Innes as the Rider of LONDON BOUND and on that basis the betting public and indeed the connections of the horse were not unduly disadvantaged.
Given the circumstance and after taking into account all the factors the Committee consider that a fine in line with the last penalty imposed is appropriate.
