Following race 7 an information was filed by the informant Mr J Oatham. This comes pursuant to Rule 868(3)(5) and it is alleged by Mr Oatham that Mr A Fieldes, trainer of CAPECOVER, raced that horse without notified gear.

--Following race 7 an information was filed by the informant Mr J Oatham. This comes pursuant to Rule 868(3)(5) and it is alleged by Mr Oatham that Mr A Fieldes, trainer of CAPECOVER, raced that horse without notified gear.
--Mr Fieldes admitted the charge.

Mr Oatham said that Mr Fieldes failed to notify the Stewards that CAPECOVER would be racing without a shadow roll and this omission was only picked up by Stipendiary Steward Mr W Robinson in the parade ring.

Mr Fieldes said in his explanation that the shadow roll was left out of his gear bag by mistake and he could not borrow one in time. He admitted that he should have told the Stewards, but he panicked and just ran out of time.

PENALTY:
--Mr Oatham submitted a fine would be appropriate but reminded the Committee that this was a listed race. He said this was Mr Fieldes’ first charge under this Rule. He suggested a $200 - $300 fine would be appropriate.

The Committee considered all submissions and took into account Mr Fieldes’ guilty plea, his co-operation with the Stewards and that this was his first offence under this Rule. The Committee reminded Mr Fieldes of his obligations regarding notification of gear and that this offence was in a listed race.
