Decision:

The protest was dismissed and the Judge's placing’s shall stand.

The Committee authorised the payment of stakes and dividends in accordance with its decision.

Facts:

Following the running of race 3, Foster Maintain 1400, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr T Harris, alleged that RU’MAR or its rider placed 1st by the Judge interfered with the chances of his horse BLUE TWILIGHT placed 2nd by the Judge.

The interference was alleged to have occurred in the final straight.

The Judge's placing were as follows:

1st No. 2 RU’MAR
2nd No. 1 BLUE TWILIGHT
3rd No. 11 READY TO ROCK
4th No. 7 VINSANITY

The official margin between 1st and 2nd was a short head.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

All connections present acknowledged that they understood the Rule.

Submissions for Decision:

Mr Harris stated that over the final 300 metres of the race RU’MAR slowly ran out and dictated BLUE TWILIGHT’S running line. He said that his mount never had a chance to go straight and in the last 100 metres the 2 horses made contact.

Mr Priscott said that there were 2 “bumps” late in the straight and it happened when BLUE TWILIGHT was moving up to go past RU’MAR. He noted the short head margin between the 2 horses at the finish.

Mr Riddell acknowledged that his mount shifted out in the final straight. He said that BLUE TWILIGHT was in front of RU’MAR for the majority of the final straight. He stated the “bump” that Mr Priscott referred to occurred when BLUE TWILIGHT shifted in and crowded RU’MAR. He said that Mr Harris never stopped riding his mount out to the finish and BLUE TWILIGHT’S momentum was not hindered. He said that the better horse won on the day and the right result would be that the placings stand.

Mr Mitchell said that he completely agreed with Mr Riddell’s interpretation of the alleged interference and had nothing further to add.

Mr Oatham was invited by the Committee to comment on the alleged interference. He observed that RU’MAR had come from behind BLUE TWILIGHT and any interference that BLUE TWILIGHT may have suffered was minimal. He said there was a little bump near the 50 metres when RU’MAR shifted out onto BLUE TWILIGHT and then that runner shifted in onto RU’MAR over the final stages of the race. He said given the short head margin the Committee must be satisfied that had the minimal interference not occurred BLUE TWILIGHT would have beaten RU’MAR.

Reasons for Decision:

The Committee carefully considered all the submissions presented and reviewed the video footage. It was evident that RU’MAR commenced to gradually shift out near the 300 metres. However, we observed that BLUE TWILIGHT’S momentum was not hampered and Mr Harris continued to ride his mount out to the finish line. It was significant to note that BLUE TWILIGHT headed RU’MAR near the 150 metres and was approximately a neck in front of that runner. We observed that near the 50 metres RU’MAR and BLUE TWILIGHT momentarily brushed and over the concluding stages of the race BLUE TWILIGHT shifted in onto RU’MAR.

The Committee was of the opinion that the minor interference that occurred did not have a bearing on the outcome of the race. Accordingly there were insufficient grounds to justify a change of placings.
