Accordingly, the protest was upheld and KAWI was relegated from 2nd to 5th place.

The amended placing’s:

Facts:

Following the running of Race 7, Lisa Chittick Foxbridge Plate Group 2, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr Oatham, alleged that KAWI placed 2nd by the Judge interfered with the chances of WHOSYOURMASTER placed 4th equal by the Judge.

The interference was alleged to have occurred in the final straight.

The Judge's placing were as follows:

1st No.3 ADDICTIVE HABIT
2nd No. 4 KAWI
3rd No. 7 TOMORROWLAND
4th No. 2 WHOSYOURMASTER
4th No. 11 THE FILLY

The official margins were 1 length, long neck, nose and a dead heat.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

All connections present acknowledged they understood the Rule.

Submissions for Decision:

Mr Robinson demonstrated the video footage and pointed out that WHOSYOURMASTER was racing well behind KAWI at the 400 metre mark. He identified that near the 250 metres Mr Parkes angled KAWI out into the line of WHOSYOURMASTER which caused that horse to lose ground and momentum. He said the run that KAWI took belonged to WHOSYOURMASTER and added that Mr Parkes was not the required distance clear. He concluded that WHOSYOURMASTER ran on very well making up ground on KAWI in the closing stages.

Mr Sharrock acknowledged there had been movement when KAWI moved out but submitted that WHOSYOURMASTER had its momentum stopped for only 1 stride. He said the distance between the 2 horses had not changed much in the run to the finish line.

Mr Parkes stated that he did come out for a run and agreed with Mr Sharrock that it only cost WHOSYOURMASTER 1 stride.

Mr McNab submitted he was travelling well and the run that KAWI took belonged to him. He said as a result of his rightful running line being taken he had to steady and take a decent hold of his mount to avoid KAWI’S heel. He identified this caused his mount to dip and lose at least 1 length. He believed but for the interference WHOSYOURMASTER would have finished 2nd if not 1st.

Mr O’Sullivan submitted that it was clear that WHOSYOURMASTER was inconvenienced for 6 to 7 strides when KAWI moved out into his rightful line. He noted WHOSYOURMASTER was making up good ground and believed the interference may have cost his horse the win.

Mr Moss submitted the films were very clear and had nothing further to add.

Mr Oatham when asked for his assessment said that approaching the 400 metres WHOSYOURMASTER was giving KAWI 5 lengths start. He said Mr McNab had to take hold of his mount near the 250 metres for 6 to 7 strides when Mr Parkes angled KAWI out into his running line. He said this cost WHOSYOURMASTER considerable momentum when it was taking ground rapidly off KAWI. Mr Oatham submitted that the margin lost by WHOSYOURMASTER was greater than the margin between the 2 horses at the finish line.

Reasons for Decision:

The Committee carefully considered all of the submissions and reviewed the video footage several times. We established at the 400 metres WHOSYOURMASTER was racing in last position and approximately 5 lengths behind KAWI. We identified that passing the 300 metres WHOSYOURMASTER was making up significant ground on KAWI. The video footage clearly shows that near the 250 metres Mr Parkes angled out KAWI when only a bare length clear of WHOSYOURMASTER. This resulted in WHOSYOURMASTER suffering interference with Mr McNab having to take a hold of his mount for about 7 strides. The interference cost WHOSYOURMASTER valuable momentum and once balanced up again WHOSYOURMASTER was taking ground off KAWI in the run to the finish line. The Committee is satisfied the interference at the 250 metres clearly cost WHOSYOURMASTER more than a long neck and a nose which was the margin between the 2 horses at the finish.

After taking into account all the above factors the Committee is of the opinion that WHOSYOURMASTER would have beaten KAWI had such interference not occurred.
