Decision:

Following race 8 Information was filed pursuant to Rule 871 (1) (d).  The Informant, Mr J Oatham alleged that Mr T Sasada permitted his mount CAPE FEAR to shift in passing the 200 metres and hampered CROSSWORD (D Johnson) who was dictated onto WATCH MY STEP (T Thornton) who was crowded and checked.

Mr T Sasada admitted the breach.

Mr Coles demonstrated the video films which clearly showed Mr Sasada approaching the 200 metres racing 3 horse widths from the inside rail, but when ridden forward with the whip he began to run in onto CROSSWORD’s rightful running line when not the required distance clear, who was then forced onto WATCH MY STEP  who was crowded and checked.

Mr Sasada admitted he shifted in and said he straightened his mount too late.

PENALTY SUBMISSIONS
Mr Sasada said he had no commitments and would like to start the penalty immediately. He said he would travel as far south as Christchurch.

Mr Oatham said Mr Sasada had 3 previous charges in the last 12 months.  He informed the Committee that Mr Sasada had just returned from a lengthy suspension in the Wellington Cup.  He stated his record was of some concern with Stipendiary Stewards and Mr Sasada needed to be mindful of this in going forward.  He said today’s interference was in the mid range and with Crossword clearly being hampered, this interference had a bearing on the final placings.  He submitted a 5-7 day suspension would be appropriate.

PENALTY
The committee carefully considered all submissions and before imposing an appropriate penalty took into account the following:
1. His guilty plea.
2. His record, in which this Committee expressed the same concerns as the Stipendiary Stewards.
3.  Level of carelessness mid range.
4. The interference suffered by Miss Johnson and Miss Thornton.
Accordingly we impose a suspension to start after racing on 14 March and to conclude after racing on 28 March 2009 (7 days).
