Consent to late scratch INTRIGUE was declined.
Facts:
Mr Dean Williams on behalf of Mr T Pike the Trainer of INTRIGUE made application for consent to late scratch that runner on the grounds that the track was too firm but the Stipendiary Stewards refused consent on the basis that there had not been a change in track conditions.
Mr Oatham read out the relevant Rule and also Rule 534(2)(a).
Submissions for Decision:
Mr Williams told the Committee that there had been a suggestion that it would rain. He said that there had been firm tracks over the past few weeks and that Mr Pike had contacted NZTR concerning the hard tracks and horses jarring up.
He then said that he spoke to the Track Manager at Te Rapa this morning and was told that the track at that stage was a good 3 with plenty of moisture and that rain was forecast.
Mr Williams said that there had been no rain during the day and it was a sunny day and the track was now firmer. He said that INTRIGUE disappointed last time on a firm track and that if Punters knew the track was a good 2 then they wouldn't back the horse.
He also said that jockeys Innes, Harris and Waddell had told him that the track was firmer.
He further said that the horse was left in the Race on the basis that it was going to rain but that hasn't happened.
Mr Oatham said that the Stewards had inspected the track this morning and decided that it was a good 3 although some Stewards thought it was a dead 4. Mr Oatham said that there was one millilitre of rain overnight.
He then said that the Stewards did not believe that track conditions had changed. He also said that most of today's winners had form on dead 4 tracks.
Mr Oatham also said that the Stewards had not had applications from any other Trainers in relation to track conditions. He further said that Trainers make decisions at 7-30am based on track conditions at the time.
He said that "clearly we cannot let Trainers make up their minds during the raceday when conditions have not changed."
Reasons for Decision:
The Committee fully understands Mr Williams' position but he has other options available to him. On the basis of the submissions put to us we declined the request to late scratch INTRIGUE due to there not being a material change in the track conditions.
