As the breach was admitted we find the charge proved.
Penalty:
It was explained to Mr Ormsby that the starting point for careless riding is now 5 days with mitigating and aggravating factors considered before increasing or decreasing the penalty from that point.
After taking all the above factors into account we impose a suspension on Mr Ormsby from riding in races which is to start after racing on 15 January and conclude after racing on 21 January 2011(4 riding days).

Facts:
Mr Williamson demonstrated the video films which clearly showed ROMAN REBEL ridden by Mr C Ormsby racing in a four wide position and on the outside of the field passing the 800 metres. On the point of the turn Mr Ormsby allowed his mount to move in and take the line of SIBERTY (D Johnson) when a bare length clear. This caused Miss Johnson to check her mount quite sharply which in turn caused a check to VERSAILLES (M Wenn).
Submissions for Decision:
Mr Williamson said as a result of Mr Ormsby moving in Miss Johnson did not have enough room to maintain her line. He said Mr Ormsby did take corrective action by turning his mount's head out but this was too late.
Mr Ormsby said he looked across several times and thought he was clear when moving in. While he admitted tightening Miss Johnson a little he believed her mount over reacted and contributed to the incident.

Mr Oatham said this was Mr Ormsby's second charge in the last twelve months which was an excellent record. He said however it was clear that Mr Ormsby had crowded SIBERTY when moving in but conceded that horse may have overreacted slightly. He submitted Mr Ormsby's carelessness was in the low to mid range.
Mr Ormsby said he had commitments until after Ellerslie on 15 January 2011.

The committee carefully considered all the evidence and submissions as presented. Mitigating factors are Mr Ormsby's admission of the breach and his excellent record. While SIBERTY may have overreacted to the inward movement of ROMAN REBEL the committee is satisfied that the interference was caused largely by Mr Ormsby moving in when not sufficiently clear.
