Facts:
The Informant, Mr Oatham filed an Information pursuant to Rule 330(3)(c) alleging that Class A Rider, Mr J Riddell failed to make the contracted weight for his two mounts in Races 4 (PIERRO ROSSO) and 7 (SAMINA BIBI) respectively. Both Races are Group 2 Races.
Mr Riddell was present at the hearing and confirmed his admission of the breach and he advised that he is familiar with the nature of the charge. The Information was endorsed to that effect.
Rule 330(3)(c) provides: “A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.
Mr Oatham advised that prior to the commencement of the meeting, Mr Riddell advised Stewards that he was unable to make the handicapped weights for PIERRO ROSSO (Race 4) and SAMINA BIBI (Race 7). He said that both horses were handicapped to carry 56.5 kg. Mr Riddell reported that he was 1 kg overweight.
Mr Oatham added that suitable replacement riders were engaged, namely J Parkes (PIERRO ROSSO) and S Weatherley (SAMINA BIBI).
By way of explanation Mr Riddell said that he was particularly disappointed in himself for not being able to make weight. He said that he was looking forward to riding both horses and despite his efforts was unable to get down to 56.5 kg.
Submissions for Penalty:
Mr Oatham said that this is Mr Riddell’s second breach within the 120-day reset period; the first breach occurred on 14 January 2021 and was dealt with by way of a Minor Infringement Notice (MIN). Mr Riddell was fined $100.
Mr Oatham said that a charge of this nature would normally be dealt with by way of a MIN, however, given that the two breaches occurred in Group 2 Races Stewards elected to proceed by way of an Information as opposed to having the matter dealt with by way of a MIN.
Mr Oatham submitted the breach could be dealt with by way of a fine.
Mr Riddell apologised to all concerned. He asked the Committee to take into account his good record.

The MIN schedule establishes a $100 fine as the starting point for a first breach of this Rule. In circumstances where Stewards elect to file an Information, determination of penalties are fact dependant.
The Committee considered the submissions and for consistency took some guidance from previous penalties for similar breaches.
The Committee took into account the fact that both breaches occurred in Group 2 Races, each with stakemoney of $100,000. As a consequence of the breaches the betting public and indeed the connections of both horses were placed at a disadvantage, albeit suitable senior replacement riders were subsequently engaged. We have treated these as aggravating factors.
We accept that Mr Riddell has ongoing weight problems and that he made a genuine effort to make the handicapped weight for both horses. Further he was also genuinely remorseful.
Given the circumstance and balancing the interests of all concerned we determined a fine to be an appropriate penalty.
