Accordingly, after taking all the above into account and being aware that Mr Dell is not riding tomorrow, 13 September we impose a suspension to start after racing today 12 September and conclude after racing on 20 September (4 days).

Facts:
Following race, 2 an information was filed pursuant to rule 638 (1) (d). Mr Oatham alleged that Mr C Dell, rider of TAKE CHARGE, permitted his mount to shift inwards when not sufficiently clear forcing GEE TEE EM inwards, crowding MANGAROA HUSTLER which was checked near the 1200 metres.
Submissions for Decision:
Mr Coles demonstrated the video films which showed TAKE CHARGE racing in a 3 wide position at the 1200 metre mark. On his inside, and a length behind was GEE TEE EM who, in turn was a length ahead of MANGAROA HUSTLER. Mr Coles submitted that Mr Dell was easing his mount as he was moving towards the rail. Because he was not sufficiently clear, this caused tightening to the runners on his inside resulting in MANGAROA HUSTLER being checked and lose 1 1/2 lengths.
Mr Dell stated that he had looked across before moving in and thought he was 2 to 3 lengths clear. He conceded that taking hold of his horse before starting his inward movement was an error of judgement.

Mr Oatham told the committee that Mr Dell had incurred 5 suspensions in the last 12 months. He submitted this was a fair record and admitted today's breach was at the low end of carelessness.
Mr Dell said he had been released from his one ride on 15 September at New Plymouth after talking to trainer Mr C Bothwell. Therefore, he wished to start the suspension immediately.
Reasons for Penalty:
The committee carefully considered all submissions and evidence. In mitigation, Mr Dell has admitted the breach which the committee considers to be at the lower end. The aggravating factor is Mr Dell's record showing 5 suspensions in the last 12 months. The chairman advised Mr Dell this was becoming a matter of concern and one which he must address.
