Accordingly the horse was declared a late scratching on veterinarian’s advice.
Facts:
Following the running of race 6 Mr B. Baker applied to the Judicial Committee to seek a ruling as to whether the horse DOCTOR FREMANTLE was in a fit condition to race.
Mr Baker had advised Mr George on race morning that DOCTOR FREMANTLE had a skin rash and it was agreed that the horse would need to be cleared when arriving on course by the race day veterinarians.
Submissions for Decision:
Dr O Fahey was asked to inspect the horse DOCTOR FREMANTLE as to whether the horse was in a fit condition to race. She said that 70% to 80% of the horse was covered in a skin rash consisting of small swellings. While the rash was not contagious it was not a good public perception. She sought a second opinion from Dr L Smith. He believed the horse may have been capable of running however told the committee the issue was one of animal welfare.
Mr Baker disputed the horse was 70% to 80% covered in a skin rash he said it was more like 20% to 30%. He said the horse had had the skin rash on and off for the last two weeks and had been working closely with his vet to rectify the skin condition, which included medicated shampooing of the horse. He said the horse worked well this morning.
Upon questioning from the committee Mr Baker admitted the skin rash had flared up when DOCTOR FREMANTLE arrived on course.
Mr George when asked had nothing to say.
Reasons for Decision:
The committee carefully considered all submissions and evidence presented. The fact of the matter is that DOCTOR FREMANTLE arrived on course with a skin rash condition that caused concern to the on course veterinarians. In their professional opinion they both believed that the horse should not be allowed to start on animal welfare grounds and public perception.
Although DOCTOR FREMANTLE was cleared by Mr Baker’s vet on Tuesday he did concede that the skin rash did flare up while the horse was on course.
The committee has to be guided by the expert opinion of the two club veterinarians.
