INFORMATION NUMBER 043
WAIKATO RACING CLUB at TE RAPA
12 DECEMBER 2009

--

Following Race 9 a protest was lodged pursuant to Rule 642 (1) by Mr C Lammas, rider of
CASABELLA LANE.  He alleged that ALAGANT SATIN, placed 5th by the Judge, caused interference to CASABELLA LANE, placed 6th by the Judge.  Mr Lammas alleged the interference occurred in the final straight.

--

Present at the enquiry were:

--

CASABELLA LANE:   Mr J Pender, trainer
                                      Mr C Lammas, jockey

--

ALAGANT SATIN:       Miss L Newton, assistant trainer
                                      Miss Spratt, jockey

--

Mr Lammas demonstrated the video films which showed at a point shortly after turning for home, Miss Spratt angle her mount, ALAGANT SATIN,  out for a better run.  In doing so she moved into the rightful line of CASABELLA LANE who had to be checked.  This resulted in Mr Lammas having to move out behind KEEPA CRUISING to gain a clear line of running.

--

Miss Spratt, rider of ALAGANT SATIN, said she heard Mr Lammas yelling out but could not see a horse there.  She said her movement was not abrupt and believed she only rolled out 1/2 a horse width.  She stated the check to Mr Lammas was minimal.  She also said the outside horse moved in slightly.

--

Miss Newton, assistant trainer of ALAGANT SATIN, said her horse was travelling well and also believed the outside horse moved in.

--

Mr Lammas had nothing further to add after his opening statement when demonstrating the film.

--

Mr Pender said the film was clear and believed the check his horse received cost him ground and he was unlucky.

--

Mr Oatham, when asked for his assessment, said Miss Spratt was not entitled to move out when she did and this resulted in the check to CASABELLA LANE.  He also said CASABELLA LANE made ground on ALAGANT SATIN after the check.

--

DECISION

--

The Committee carefully considered all evidence and reviewed the video films before making a decision.  We are clearly satisfied that Miss Spratt did take the line of CASABELLA LANE which caused that horse to be checked.  We do not believe the outside horse contributed to the interference in any way.  After changing ground CASABELLA LANE made up considerable ground on ALAGANT SATIN and was only beaten by a nose.  Because of the ground lost by CASABELLA LANE, the strong manner in which it was finishing and the nose margin at the post, the Committee is satisfied that had the interference to CASABELLA LANE not occurred, it would have beaten ALAGANT SATIN.

--

Accordingly the protest is upheld and the placings shall now be:
