Mr G Stewart demonstrated the video which clearly showed Mr Colgan's movement across, taking the line of FIGURE OF SPEECH when not sufficiently clear.

As Mr Colgan had pleaded guilty we are only required to consider penalty.

Mr Oatham gave Mr Colgan's excellent record, and said that although he had admitted the charge, which was at the lower end of the scale, he asked for a suspension.

Mr Colgan gave notice of his riding plans.

After taking all submissions into consideration the Committee suspends Mr Colgan from the conclusion of racing on 15 November until the conclusion of racing on 19 November 2006.
