As the breach was admitted we find the charge proved.
Penalty:
Accordingly and under the provisions of rule 1106 (2) we suspend Mr Riddell from riding in races which is to start after racing on 18 February and conclude after racing on 24 February 2012 (4 days).

Facts:
Following race 5 an information was filed pursuant to rule 638 (1) (d). Mr J Oatham alleged that near the 1800 metres Mr J Riddell (CAPITAL DIAMOND) permitted his mount to shift in when not clear of PUSSY O'REILLY (Miss S Collett). PUSSY O'REILLY was then forced into the line of QUINTESSENTIAL (Mrs L Allpress) which had to check.
Submissions for Decision:
Mr Coles demonstrated the video films which showed CAPITAL DIAMOND racing in a 4 wide position at the 1800 metres. It was evident on the films that Mr Riddell then allowed his mount to lay in putting pressure on PUSSY O'REILLY (Miss S Collett). This caused Miss Collett to move in slightly and check QUINTESSENTIAL (Mrs Allpress). Mr Coles stated that Mr Riddell was not more than 1 length clear when moving in.
Mr Riddell said his mount was over racing and he was trying to get her to relax. He admitted he did put pressure on Miss Collett but it was marginal.

Mr Oatham said Mr Riddell had a very good record with only 1 three day suspension in the last 12 months. He said it was not ideal for Mrs Allpress having to check in a Group 2 race but conceded the check was minor and Mr Riddell's carelessness was at the low end. He reminded the committee it was a Group 2 race.
When asked by the committee as to why he was not submitting a fine in addition to a suspension which is normal in a Group 2 race he responded by informing the committee he did not think Mr Riddell's level of carelessness warranted such.
Mr Riddell was given time to consult his manager to confirm his upcoming engagements. He told the committee he had commitments up to and including February 18.

The committee carefully considered all the evidence and submissions. Mitigating factors are Mr Riddell's admission of the breach, his outstanding record and his level of carelessness which the committee finds to be at the low end. Normally, because this was a Group 2 race, this breach would warrant a 5 day suspension. However because of the compelling mitigating factors above we reduce this to one of 4 days.
