Accordingly for the above reasons we are not satisfied LADY CHAPEL would have beaten ESTRATO if interference had not occurred. Therefore the protest is dismissed and the judge's placings shall stand.
We order the dividends to be paid in accordance with the result.
Facts:
Following race 3 a protest was lodged pursuant to rule 642 (1). The informant Mr K Hawtin alleged that ESTRATO placed first by the judge interferred with the chances of LADY CHAPEL placed second by the judge. This interference was alleged to have occurred near the 500 metres.

Submissions for Decision:
Mr Hawtin demonstrated the video films and pointed out to the hearing his horse LADY CHAPEL receiving buffeting from ESTRATO and SAVABILL on her inside. He believed this was caused by Miss Spratt coming out with the result costing LADY CHAPEL one to one and a half lengths.
Mr J McDonald said he received pressure from Miss Spratt on his inside. This resulted in him checking off the heels of Mr Innes losing ground which he believed cost him the race.
Miss Spratt denied coming out interfering with Mr McDonald at the 500 metres and said she was holding her line inside SAVABILL which she was entitled to do.
Mr Oatham when asked for his submission said the videos were inconclusive but questioned what bearing the alleged interference would have had on the result when it occurred 500 metres from the finish.
Mr Hawtin when asked to sum up said he had nothing further to add from his earlier evidence.
Reasons for Decision:
It was clear to the committee there was no evidence to support the submission that Miss Spratt had come out. It was obvious at the 200 metres that Mr McDonald was holding a length advantage over Miss Spratt. From there on both horses had a clear run to the line with ESTRATO coming from behind and beating LADY CHAPEL by half a length.
