As the breach was admitted we find the charge proved.

Accordingly and under the provisions of rule 1106 (2) we impose a suspension on Mr Lammas from riding in races which is to start after racing on 17 November and conclude after racing on 25 November (5 days).

Facts:
Following race 6 an information was filed pursuant to rule 638 (1) (d). The informant Mr J Oatham, alleged that Mr Lammas angled his mount GALAXY ROAD outwards passing the 400 metres when not sufficiently clear into the line of CHAPEL BAY which was checked.
Submissions for Decision:
Mr Coles demonstrated the video films which showed GALAXY ROAD ridden by Mr Lammas racing at the rear of the field and on the inside and slightly ahead of CHAPEL BAY (A Calder). At the 400 metre mark Mr Lammas angled his mount out for a run but in doing so took the line of CHAPEL BAY. Mr Coles submitted there was firm contact between the 2 horses with CHAPEL BAY becoming unbalanced and losing 1 to 1 1/2 lengths.
Mr Lammas admitted he angled out but didn’t realize Mr Calder was there as he thought he was the widest runner.
Submissions for Penalty:
Mr Oatham submitted that Mr Lammas had incurred 3 suspensions for careless riding in the last 12 months. He believed today’s breach was in the mid range as CHAPEL BAY had received quite a sharp check at a vital stage of the race. He explained Mr Lammas would be serving a suspension which he incurred recently and which concluded on 16 November.
Mr Lammas confirmed Mr Oatham’s submission and added he had confirmed rides at Tauranga on 17 November.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. The only mitigating factor is Mr Lammas’ admission of the breach. We took into account his record which we considered fair and one which Mr Lammas was warned about. The aggravating factor was the sharp check received by CHAPEL BAY caused by Mr Lammas angling out when insufficiently clear. Taking all these factors into account we find an appropriate penalty is one of 5 days.
