As the breach was admitted we find the charge proved.
Penalty:
Accordingly and under the provisions of rule 1106(2) we suspend Mr Shirahama from riding in races which is to start after racing on 12 November and conclude after racing on 17 November 2012 (4 days).

Facts:
Following Race 5 an information was filed pursuant to rule (638(1) (d). The informant Mr J Oatham alleged that Mr Shirahama permitted his mount MIDNITE RENDEZVOUS to shift outwards passing the 300 metres when insufficiently clear crowding COOGEE FLYER which lost its rightful line of running to which it was entitled.
Submissions for Decision:
Mr Coles demonstrated the video films and pointed out MIDNITE RENDEZVOUS racing in the middle of the track and in a prominent position approaching the 300 metres. It was then evident that Mr Shirahama angled his mount out for a better run but in doing so take the line of COOGEE FLYER when insufficiently clear. Mr Coles said this caused COOGEE FLYER to lose approximately one and a half lengths after which he finished strongly to end up in 3rd place. Mr Shirahama had no submissions to make.
Submissions for Penalty:
Mr Oatham produced Mr Shirahama’s record which showed only one suspension in the last 12 months. Mr Oatham submitted today’s breach was towards the low end although the impact on COOGEE FLYER may well have had an effect on the result.
Mr Shirahama said he had commitments up to and including the Avondale meeting on the 12th November and he only rode as far south as the Central Districts.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. Mitigating factors are Mr Shirahama’s admission of the breach and his excellent record. However the aggravating factor was the mistake Mr Shirahama made when angling out and into the line of COOGEE FLYER when not sufficiently clear. Clearly he continued riding forward without taking corrective action. The committee finds Mr Shirahama’s breach to be in the low to mid range because COOGEE FLYER did have its chances considerably affected. It was explained to Mr Shirahama that this breach would normally warrant a 5 day suspension but because of the mitigating factors explained we reduce this to one of 4 days.
