Following Race 7 a protest was lodged by the informant Mr J Oatham, under Rule 876 (1) when he alleged that MYBIGFATGREEKHORSE placed 1st by the Judge, interfered with the chances of MARNO, placed 4th by the Judge



Following Race 7 a protest was lodged by the informant Mr J Oatham, under Rule 876 (1) when he alleged that MYBIGFATGREEKHORSE placed 1st by the Judge, interfered with the chances of MARNO, placed 4th by the Judge.

It was confirmed all connections were informed of the protest.

The margin between 3rd and 4th was 1 3/4 lengths.

Present at the enquiry were :

MYBIGFATGREEKHORSE - Trainer Mr P Lock and rider Mr B McDonald.

MARNO - Mr D Weatherly, representing Trainer Mr J Sargent and rider Mr M Cameron.

Stipendiary Steward Mr Coles demonstrated the video films and showed that at approximately the 100 metre mark MYBIGFATGREEKHORSE ducked out sharply and into the line of MARNO who was approximately 1/2 length behind at the time. Mr Coles believed MARNO lost approximately 2 lengths and all momentum as a result.

Mr Cameron, rider of MARNO, said that initially he was only battling but then got going to be about 1/2 length behind MYBIGFATGREEKHORSE when his line was taken by that horse which cost him 2 lengths. He said he was a winning chance at the time.

Mr Weatherly said it was unfortunate that MYBIGFATGREEKHORSE ducked out so sharply but at the time MARNO was grinding his way to the line and his chance was extinguished.

Mr Lock admitted his mount has ducked out sharply but once straightened believed he ran too strongly to the line for MARNO to beat him.

--

Mr J MacDonald, rider of MYBIGFATGREEKHORSE, said although he ducked out sharply, Mr Cameron was only battling at the time.

DECISION

--

The first question the Committee must answer was to determine was there any interference. It was clearly evident that MYBIGFATGREEK HORSE did duck out sharply into the line of MARNO who received a severe check.

We also are clearly of the opinion that the chances of MARNO finishing in a better place were affected, as he lost 2 lengths through MYBIGFATGREEKHORSE moving into his line without being the required distance clear.

In applying our discretion, we have determined the protest should be upheld because :

  1. At the time of the interference MARNO was only 1/2 length behind MYBIGFATGREEKHORSE and was finishing quite strongly.

  3. The films clearly showed MARNO lost 2 lengths as a result of this interference.

  5. The momentum lost by MARNO.
