Following race one an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Mr J Oatham, that T Harris permitted his mount NUKE TIME to shift outwards when not sufficiently clear
Following race one an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Mr J Oatham, that T Harris permitted his mount NUKE TIME to shift outwards when not sufficiently clear of OMERTA (D Johnson) who was checked.
----Mr T Harris pleaded guilty and was represented by Mr P Lock.
----Mr Coles demonstrated the video films and showed where soon after turning for home Mr Harris angled his mount NUKE TIME out for a better run and in doing so moved into the line of OMERTA who had to be checked as a result. Mr Harris was not the required distance clear of OMERTA when taking that horse’s line.
----Mr Harris said his mount over-reacted when he moved out, but admitted he could have done more in trying to straighten NUKE TIME.
----Mr Lock had little to add other than that NUKE TIME appeared to over-react when Mr Harris moved out.
----Mr Oatham said he agreed that NUKE TIME may have over-reacted, but Mr Harris had continued to ride forward and could have done more in straightening his mount.
----PENALTY:
--Mr Oatham produced Mr Harris’ record which showed Mr Harris had 5 previous charges under this Rule in the last 12 months. He added this was of some concern. He said the Committee should consider his early guilty plea and also believed this particular transgression was at the lower end of the scale. He believed a suspension of 4 – 5 days would be appropriate.
----The Committee considered all submissions and took into account Mr Harris’ prompt guilty plea. However, we are concerned that this is Mr Harris’ sixth offence in the last 12 months which was portrayed strongly to Mr Harris. We believe this offence, after considering Mr Harris’ record, would normally warrant a 5 day suspension, but agree with Mr Oatham that this was at the lower end of carelessness.
----When asked for his commitments Mr Harris said he had 4 rides at Tauranga on 17 November which he would like to fulfil. Mr Oatham had no objection to this request. Accordingly we impose a suspension to start after racing on 17 November and conclude after racing on 24 November (4 days).
