As Ms Collett admitted the breach the Committee found the charge proved.

Penalty:

The Committee grants a deferment to Ms Collett’s suspension as per Rule 1106(2).

Accordingly, Ms Collet had her license to ride in races suspended for a period to commence after racing on 17 June and conclude after racing on 22 June 2017 (3 days).

That period of suspension encompasses meetings at

18 June– Te Awamutu

21 June – Pukekohe

22 June – Oamaru

 

 

Facts:

Following the running of race 8,Dow Agrosciences NZ 1600, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Ms Collett allowed her mount EL CAJERO to shift out when not sufficiently clear of REBEL ROSE (G Cooksley) which was checked near the 300 metres.

Ms S Collett acknowledged that she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Jones using the available video footage identified that Ms Collett allowed her mount to shift out 2 to 3 horse widths near the 300 metres. He said that Ms Collett was only a bare length clear of REBEL ROSE which was checked.

Ms Collett said she looked to her outside prior to shifting out and she did not see Mr Cooksley. She acknowledged that the films showed that she was not the required distance clear when the incident occurred.

Submissions for Penalty:

Mr Williamson said that Ms Collett has had 792 rides to date this season and remarkably she had not breached this Rule in the last 12 months. He said while the outward shift was abrupt the check to REBEL ROSE was not severe. He said Ms Collett should be given credit for her admission of the breach, her co–operation with Stewards and her remarkable record. Mr Williamson submitted a low end suspension is appropriate.

Ms Collett advised that she had engagements at Whangarei on 17 June and any proposed suspension could start after that date.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point for careless riding is a 5 day suspension.

When reviewing the incident the Committee observed that Ms Collett shifted out in a rapid manner however, that the check to REBEL ROSE was minimal.

There were no aggravating factors.

The significant mitigating factors were Ms Collett’s irresistible record, her admission of the breach and the check to REBEL ROSE was low end.

It was recognised by all parties that Ms Collett has a history of riding throughout the country on a regular basis.

After taking into account all the above factors and placing emphasis on Ms Collett’s exceptional record the Committee considered an appropriate suspension was 3 days.
