As Mr McNab admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Mr McNab was fined the sum of $350.

Facts:

Prior to the running of race 4, Farmlands Hautapu 2100, an Information was filed pursuant to Rule 330 (3)(c). The Informant, Mr Williamson, alleged that Mr McNab failed to make the contracted weight for TWINKLES.

Mr McNab acknowledged that he understood the Rule and admitted the breach.

Rule 330(3)(c) provides: “A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.

Mr Williamson advised that Mr McNab was a “fraction over” the agreed weight of 54.5kgs. He said that Ms Johnson was the replacement rider of TWINKLES.

Mr McNab said that he had done his best to make the contracted weight.

Submissions for Penalty:

Mr Williamson’s said that Mr McNab had breached this Rule twice in May this year where he was fined the sum of $200 and $300. He submitted a fine of not less than $300 would be appropriate for today’s breach.

Mr McNab submitted that a $350 fine should be imposed.

The Committee carefully considered all the evidence and submissions presented.

The aggravating fact was that Mr McNab incurred a $300 fine when unable to make the contracted weight on 20 May.

The mitigating fact was Mr McNab’s admission of the breach.

The Committee considered that a small increase on Mr McNab’s recent fine was applicable.
