As Ms Spratt admitted the breach the Committee find the charge proved.

Penalty:

We grant Ms Spratt’s request to seek a deferment to her suspension as per Rule 1106(2).

Accordingly, Ms Spratt had her license to ride in races suspended for a period to commence after racing on 14 December and conclude after racing on 24 December 2016 (4 days)

That period of suspension encompasses meetings at

15 December - Otaki

17 December - Te Rapa/Palmerston North (Premier)

21 December - Tauranga

24 December - New Plymouth

Facts:

Following the running of race 5, Dunstan Feeds Premier, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Ms Spratt permitted her mount ROUGH CUT to shift outwards when not sufficiently clear of JAYLA MONET which was checked near the 150 metres.

Ms Spratt acknowledged that she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coles demonstrated the incident using the available video footage. He pointed out that Ms Spratt was riding her mount out when it shifted 1 horse width and into the line of JAYLA MONET. He said this resulted in that runner being crowded for room and Ms Johnson had to take a hold of JAYLA MONET.

Ms Spratt acknowledged that her mount did shift out under pressure near the150 metres. She said Mr Bosson may have contributed to the incident when his mount shifted in slightly.

Submissions for Penalty:

Mr Oatham produced Ms Spratt’s record which showed 3 previous breaches under this Rule in the last 12 months. He noted Ms Spratt’s last breach was in April 2016 and described her record as a neutral factor. He said Ms Spratt should be given credit for her admission of the breach and considered the level of carelessness was below mid–range. He submitted a 4 day suspension would be appropriate.

Ms Spratt advised that she had upcoming engagements at Matamata on 14 December and sought a deferment to any proposed suspension.

In response to a question from the Committee, Ms Spratt advised that she was intending to ride at Otaki next week. Ms Spratt was forthright in that she had no intention of riding in the South Island.

Mr Oatham produced Mr Spratt’s recent riding history which showed she had ridden in the Central Districts on Industry days. Mr Oatham said he had no objection to those days being included in her penalty.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point for careless riding is for a 5 day suspension which is adjusted based on the mitigating and aggravating factors.

The mitigating factors were Ms Spratt’s admission of the breach and we deem the level of carelessness to be minor and at the low end of the scale for which a discount was applied.

We consider Ms Spratt’s record to be average but it was noteworthy that she has not breached this Rule for 8 months.

The Committee accept that Ms Spratt does occasionally travel to the Central Districts on Industry days.

After taking into account all the above factors the Committee considers an appropriate suspension was 4 days.
