Facts:
Following the running of the HARCOURTS TE AWAMUTU 2YO RUBY an Information instigating a Protest was lodged by Chief Stipendiary Steward Mr N Ydgren against the 5th placing of DOFF YOUR CAP (driver C Jones) on the grounds that it broke in the final 200 metres and continued in a break in excess of 50 metres.
Rule 870(3) provides: that any horse that breaks during a race shall promptly return to its proper gait.
The Breaking Horses Regulations provide: that any horse which breaks from its gait in the final 200 metres of a race and continues in a break for more than 50 metres shall be in breach of Rule 870(3).
Mr C Jones the driver of DOFF YOUR CAP advised the Committee by noting on the Information that the Protest was not contested and that he did not wish to be present at the Hearing.
Mr Ydgren demonstrated the incident by use of the race films and showed where DOFF YOUR CAP broke in the home straight and galloped for approximately 70 metres.
