Facts:

Following the running of Race 2 a protest was instigated by the Stewards against the placing of the 4th horse, AHWEL on the grounds that it had broken for in excess of 50 metres inside the final 200 metres.

Mr D Ferguson the Driver of the horse represented the horse's connections and noted on the Information that he did not contest the protest.

Rule 870(3) states 'Any horse which breaks from its gait shall promptly regain its proper gait'.

The Breaking Horses Regulations (b) provide that 'Any horse which breaks from its gait within the final 200 metres of any race and continues on in a break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to regain its proper gait'.

Submissions for Decision:

Mr Dooley identified the horse AHWEL on the video. As the horses entered the home straight AHWEL angled in towards the passing lane. Shortly after it went into a gallop and continued on in a gallop for approximately 70 metres. The horse regained its gait short of the winning post however it had already done the damage.
