The rotest is upheld and OUR SPITFIRE is disqualified from 5th place and the race.

The amended placings are now :

First equal - (7) SAVITSKAYA

First equal - (11) NATTY PAGGER

Third - (6) FLYING TAINE

Fourth - (2) DANKE

Fifth - (1) BURT MUNRO

It was ordered that dividends and stakes be paid in accordance with the amended placings.

Facts:

Following the running of the BLACK DOG FURNITURE TROT, an Information Instigating a Protest was lodged by Senior Stipendiary Steward, Mr S Mulcay against the 5th placing of OUR SPITFIRE on the grounds of breaking from its gait inside the last 200 metres of the race and remaining in a break in excess of 50 metres.

Rule 870(3) provides: that any horse that breaks from its gait during a race shall promptly return to its normal gait.

Part (b) of the Breaking Horses Regulations provides: Any horse which breaks from its gait in the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.

Co-Trainer of OUR SPITFIRE Ms M Wallis endorsed the Information to the effect that she did not contest the Protest and did not wish to be present at the Hearing.

Mr Mulcay  demonstrated the incident by use of the race films and showed where OUR SPITFIRE was finishing strongly in the straight and it broke at the 100 metres mark and continued in a break to the finishing line.

Submissions for Decision:

Mr Mulcay submitted that as OUR SPITFIRE had galloped in excess of 50 metres inside the last 200 metres of the race that it was in breach of Rule 870(3) and the Breaking Horses Regulations and should be disqualified from 5th placing.
