As Mr Jamieson has admitted the breach the charge is proved.

Penalty:

The Committe suspended Mr Jamieson's driving licence from after racing on 11 March 2021 until after racing on 26 March 2021, a suspension of 3 days.

The meetings involved are:

Cambridge Harness - 18 March, Palmerston North - 23 March, Auckland Harness - 26 March.

Meetings at Auckland on 12 March and at Palmerston North on 16 March were not deemed to be included in this suspension period as driving engagements were finalised (Auckland)  and the field declared at Palmerston North on 16 March.  Mr Jamieson was not driving at either meeting.

Facts:

Following the running of Race 8, the Stewards submitted an Information alleging that Open Driver, Mr C Jamieson, driving KISSME QUICK, drove carelessly near the 250m by allowing his mare to shift inwards causing interference to ULTIMATE MOMENT, driven by Mr J Robinson, which broke, losing all chance.

Mr Jamieson was present at the hearing and acknowledged that he :

(a) understood the Rule, and

(b) that he admitted the breach.

Rule 869(3)(b) states: No driver in any race shall drive carelessly.

Using the films Mr Dooley identified the horse KISSME QUICK as the field neared the 250m. The horse was in second position one out, and then shifted down towards the marker pegs. In doing so it contacted the front legs of ULTIMATE MOMENT which went off stride and lost any chance it had in the race. Mr Dooley added that it was the Stewards belief that ULTIMATE MOMENT would have filled a place in the race if not for this incident.

Mr Jamieson said that KISSMEQUICK was having its first race start and that it had not been his intention to shift inwards towards ULTIMATE MOMENT, however the movement by the horse was quick and took him by surprise.

Submissions for Penalty:

Mr Dooley referred to the JCA Penalty Guide which provides a starting point of a fine of $500 or a 10 drive suspension. He said that since the interference had caused ULTIMATE MOMENT to break and lose its chance the Stewards would be seeking a suspension of Mr Jamieson's driving licence.  He added that KISSME QUICK was a 'green' horse having its first raceday start.

Mr Dooley said Mr Jamieson had one prior beach of this Rule, on 9 October 2020, when he was fined $200.

Mr Jamieson said he would have preferred a fine however he understood the reasons that he may be suspended. He added that he would not seek a deferment of his suspension. He said he intended to take a horse he trains to the Palmerston North upcoming races, and had driven there on previous occasions.

Reasons for Penalty:

The Committee confirmed the provisions of the Penalty Guide relative to this Rule. Since the interference involved had caused a horse to break and lose its chance the Committe determined that a suspension was called for. The Committee took into account that the horse involved was inexperienced and was having its first start.
