Facts:
Following the running of race 5, the NZB Standardbred Handicap Trot 2700m, two Information’s instigating protests were filed pursuant to Rule 870(3) by Senior Stipendiary Steward, Mr Muirhead.
Information 1 (A2230) alleged that the 5th placed THE REV broke in excess of 50 metres inside the final 200 metres in breach of the Breaking Horse Regulations.
Information 2 (A2231) alleged that (after being promoted to 5th place) GREY STOKE galloped in excess of 150 metres during the middle stages of the race in breach of the Breaking Horse Regulations.
In both cases the Information’s were endorsed “I do not wish to be present at the hearing”. Neither protest was contested.
The Judge’s provisional placings were:
1st – No 8 ALDEBARAN BONNY
2nd – No 2 PRESIDENTIAL JEWEL
3rd – No 7 THE LAST GAMBLE
4th – No 12 FIRA
5th – No 1 THE REV (subsequently disqualified)
6th - No 13 GREY STOKE (promoted and subsequently disqualified)
Rule 870(3) provides that 'Any horse which breaks from its gait shall promptly regain its proper gait'.
The Breaking Horses Regulations provide that:
(a) Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.
(b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.
Submissions for Decision:
Using available race films Mr Muirhead identified both breaches. Firstly he identified that GREY STOKE which was racing near the rear of the field at the 1950 metre mark broke and continued in a gallop to the 1600 metre mark, a distance of approximately 350 metres. Mr Muirhead submitted that the horse was therefore in breach of the relevant Rule and Horse Breaking Regulations and should be disqualified from the race. GREY STOKE finished in 6th place.
Secondly, Mr Muirhead then showed that the 5th placed horse, THE REV broke and galloped at the 100 metre mark and continued in a break across the finish line. Mr Muirhead submitted that the horse was therefore in breach of the relevant Rule and Horse Breaking Regulations and should be disqualified from 5th place.
Reasons for Decision:
After hearing submissions and reviewing the race films it was clear to the Committee that both horses broke and galloped in breach of r 870(3) and the relevant Breaking Horse Regulations. Accordingly, both horses, namely THE REV and GREY STOKE are disqualified.
As consequence of the 7th placed horse CAITLIN’S SURPRISE was promoted to 5th place.
