Facts:
Following the running of Race 6, the MOTHERS DAY FUN RUN AT CAMBRIDGE HANDICAP TROT 2700m, Mr Mulcay lodged a Protest by way of a Information. He alleged that the 3rd placed ANSE VATA gained an advantage when shifting inside the marker line near the 300m.
Ms A Mangos, representing the connections endorsed the Information to the effect that the protest was not contested. Ms Mangos was not present at the hearing.
Rule 869(7B) provides that 'where any horse or its sulky wheel moves inside the track marker line and gains an advantage the horse shall be disqualified from that race except where it is established that the breach was caused by interference by another horse or horseman'.
Submissions for Decision:
Using the available films Mr Mulcay identified the horse ANSE VATA as the field passed the 350 mark. The horse was in the lead, however it had gone off-stride and was galloping. At about the 300m mark, Mr B Mangos, the driver of ANSE VATA angled the horse inside the markers. Mr Mangos had explained to Stewards that he took this action for safety reasons. The horse was still galloping at that time, however shortly after it began to pace again. Mr Mangos then allowed the horse to cross the markers again to be on the race surface. The horse continued on in its correct gait and was in 3rd position past the finishing post.
Mr Mulcay stated that the Stewards believed that the horse had gained an advantage by crossing inside the markers and should be disqualified. This was not contested by the connections.
Reasons for Decision:
It was clear from the films that the horse ANSE VATA had crossed the markers near the 300m point and galloped for a time before crossing back onto the race track and pacing to finish in 3rd place. However it was also clear that in doing so the horse had gained an advantage and therefore should be disqualified from the race.
