 As the breach is admitted the charge is proved.

 A fine of $200 is imposed on Mrs Teaz.

Facts:

 Prior to the running of Race 7 Mr Mulcay submitted an Information in which he alleged that Mrs M Teaz, the co-trainer of ARMED REACTOR had failed to notify the scratching of that horse from Race 7 to the Club Secretary by the official scratching time.

Mrs Teaz was present at the hearing and acknowledged that she :

Understood the Rule, and that she admitted the breach.

Rule 834(1) provides that " Any person intending to scratch a horse from a race after it has been deemed to have accepted therefore, shall give notice to the Secretary of the Club to that effect before the official scratching time which shall also be the official right of re-entry for any race meeting'.

Mr Mulcay said that as the meeting today was a 'twilight' racemeeting the official scratching for all races was 7.30am this morning.

Mr Mulcay said that Stewards had been supplied with a Veterinary Certificate dated 24 October which stated that the horse Armed Reactor had been examined that day and found to be dull and had swelling in its limbs. The horse was therefore considered to be unfit to run today.

Mr Mulcay added that enquiries made with the Vet. established that the horse had been examined at about 8.15 on the day prior to the raceday and that a blood sample had been taken. The results of that sample was forwarded by email to the trainers at 11.37am that day.

As a result of that examination and sample test the trainers had ample time to scratch the horse on the day prior to raceday.

Mrs Teaz accepted the facts outlined by Mr Mulcay and had nothing to add.

Submissions for Penalty:

 Mr Mulcay said that there were no horses on the ballot in the race concerned, however he informed the Committee that the Club would have been disadvantaged as they still had to pay the driver a driving fee. He said that he would leave the penalty to the Committee to determine.

Mrs Teaz had nothing to add.

Reasons for Penalty:

 The Rule has two parts and penalties involved are determined likewise-it depends if any horses were denied a start as a result of the failure to notify scratchings in time.

In ths case no horses were disadvantaged. Other penalties imposed by Committees in similar circumstances have led to fines of $200.

This Committee sees no reason to vary from that.
