Ms Young admitted the breach, which we thus find proved.

Alleged breach of Rule 869(2)(a)

Facts:

Mr Wallis, Stipendiary Steward, alleged that Ms Young, the driver of MIXED EMOTIONS, which finished 2nd in race 2, the PANSPACIFICFLIGHT@Macca Lodge Pace, used her whip excessively over the concluding stages.

Rule 869(2)(a) provides:  that no horsewoman shall during any race use her whip in an unnecessary, excessive or improper manner.

Submissions for Decision:

Mr Wallis demonstrated on the videos that the respondent used the whip some 20 times from the home turn and during the run home. There were two strikes as the horses exited the turn and then 18 in the straight. He stated he was concerned about the continuous nature of the respondent’s whip action. The strikes were not the most forceful but they were repetitive.

Ms Young stated that she understood the rule and accepted she was in breach of it. She said she was pleased at how well her horse was travelling and she had let the heat of the moment get to her. She apologised for her actions.

Submissions for Penalty:

Mr Wallis produced the respondent’s record which was clear under this rule this and last season. In that time she had had 80 drives. He asked for a fine of $200.

Ms Young said she was a student and asked us to take her financial circumstances into account.

Reasons for Penalty:

We accept Mr Wallis’s count of 20 strikes is correct. There were some pauses and two or three were backhanders. However, some strikes were of a quick-fire nature and one or two were quite forceful.

After taking into account the respondent’s admission of the breach, that she co-operated fully with the stipendiary stewards’ inquiry, her clear record, and that she is a junior driver, we impose a fine of $175 and remind her of her professional obligations.
