Facts:
Mr Renault alleged that Mr Shinn failed to give notice to the Secretary of the Club that MISS IMPRESSION was to be scratched before the right of re-entry time.
Rule 834(1) provides: “Any person intending to scratch a horse from a race after it has been deemed to have accepted therefore, shall give notice to the Secretary of the Club to that effect before the official scratching time which shall also be the official right of re-entry time for any race meeting.”
Mr Renault stated that a veterinarian certificate had been provided on Thursday 22 October to the effect that MISS IMPRESSION was not fit to start.
The Stewards realised that MISS IMPRESSION had not been scratched by the official scratching time of 5pm, 24 October. The Stewards contacted Mr Morrison and the horse was scratched at 6.40 pm. Mr Renault noted that no horse had been denied a start as a consequence of the Respondent’s omission.
Mr Morrison explained that there had been trials that day and it was an honest mistake. It was remedied immediately they were contacted by the Stewards.
Submissions for Penalty:
Mr Renault submitted a penalty of $200 was appropriate. There had been two previous cases of a breach of this Rule and that was the penalty that had been imposed on each occasion.
Mr Morrison emphasised it was an oversight.
Reasons for Penalty:
No horse was denied a start which has lessened the gravity of the breach. While the time frame was only just over an hour and a half, it was only as a result of the Stewards contacting the Respondent, that the horse was scratched.
Previous breaches of this Rule in these circumstances have resulted in fines of $200. There is no reason not to impose a similar penalty in this case.
