Decision:

As Mr Campbell had admitted the breach, the charge was found proved.

Penalty:

Accordingly, Mr Campbell’s Class B Jockeys licence is suspended from the conclusion of racing 6 April up to and including 13 April 2019.

Facts:

Following the running of Race 10, the Clareview Park Stud Stayers 2100, an Information was filed by Stipendiary Steward, Mr M Davidson, against Class B Rider, Mr C Campbell alleging careless riding in that he permitted his mount, SITARIST, to shift inward near the 50m crowding LADY EM, ridden by Miss J Fawcett and ADVENTURESS, ridden by Miss A Comignaghi, both of which had to steady.

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless”

Mr Campbell had indicated on the Information that this breach of the Rules was admitted, which he confirmed at the hearing. Mr Campbell also agreed that he understood the charge and the Rule it was brought under. Mr D Walsh, NZTR Apprentice Mentor, assisted Mr Campbell at the hearing. 

Mr Davidson gave evidence and used video coverage, with the assistance of Stipendiary Steward, Mr N McIntyre, to show that nearing the 50m, SITARIST, ridden by Mr Campbell, was racing approximately 7 off the rail with LADY EM, ridden by Miss Fawcett and ADVENTURESS, ridden by Miss A Comignaghi, racing on his inside. Mr McIntyre pointed out Mr Campbell on an inwards movement when under a ride and using the whip. He said that Miss Fawcett and Miss Comignaghi were both crowded and checked out of their respective positions. Mr McIntyre used the side on films to show that Mr Campbell was only a bare length ahead of Miss Fawcett with Miss Comignaghi ¾ length back on Miss Fawcett. He stated that Mr Campbell had shifted in approximately 2 horse widths.

Mr Davidson added that there was some minor movement outwards from the inside horses with this incident, being BABAN, ridden by Mr C Johnson, who shifted out slightly forcing VEE TWELVE, ridden by Miss T Jonker, out to meet ADVENTURESS who was being forced in by Mr Campbell. Mr Davidson said that THAILAND, ridden by Miss S Collett, was steadied when placed in restricted room between both sets of runners, shifting ground.

Mr Walsh stated that the incident looked worse on the head on film than on the side on film. He added that both horses affected were tiring runners and it would have been only another stride or two and Mr Campbell would have been clear of them. He said it was clear that Mr Campbell was using the whip and shifting in causing the interference to both LADY EM and ADVENTURESS.

Mr Campbell stated that he had shifted in, but the inside horses did shift out. He said that had he waited 2 to 3 more strides he would have been clear. Mr Campbell said he had just needed to put the stick away and straighten the horse.

Submissions for Penalty:

Mr Davidson stated that Mr Campbell had 2 previous breaches in the past 12 months being 24 April 2018 at Dunedin, where he received a 7-day suspension and 13 June 2018 at Timaru where a 6 day suspension was imposed. He said that Mr Campbell had not had a breach of this rule in 9 months and considering number of rides since that last breach, he submitted, had a good record. Mr Davidson stated that this breach was low end and consideration be given for Mr Campbell’s admission of the breach.

Mr Campbell elected to make no submissions in regard to penalty apart from requesting a deferment of penalty until after Saturday 6 April at Riccarton. Mr Walsh said that Mr Campbell’s record could be regarded as good due to the number of rides he has had in the 9 months since his last breach.

Reasons for Penalty:

This Committee agreed with the Stewards that this breach was at a low level and accordingly adopted a 6 National day starting point for this offence. Although Mr Campbell has two previous breaches under this rule in the past 12 months, being 9 months and nearly 12 months prior, this Committee were prepared to treat his record as neutral. We were, however, able to afford Mr Campbell a discount for his admission of the breach, which we set at 1 day. We therefore determined that a 5 National day suspension was an appropriate penalty in this case.

Mr Campbell's application for a deferment until after racing on Saturday 6 April is granted.
