As Mr White had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).

Penalty:

Accordingly, Mr White was fined the sum of $300.

Facts:

Following the running of Race 2, the Bishopdale/Bush Inn TABs/ Tavern Harewood Mobile Pace, an information was filed by Stipendiary Steward Mr S Renault against Advanced Amateur Horseman, Mr A White, alleging a breach of Rule 869(3) (b) in that he drove carelessly by allowing ONEDIN HIGHLANDER to shift down racing into the first bend, when not clear to do so.

Mr White had indicated on the Information that this breach of the Rules was admitted. Mr White had also informed the Stewards that he did not wish to be present at the hearing.

Rule 869(3)(b) reads as follows:

“(3) No horseman in any race shall drive:-

(b) carelessly:-

Mr Renault gave evidence and used video coverage, with the assistance of Stipendiary Steward, Mr S Wallis, to show that shortly after the start and racing into the first bend, Mr White, driving ONEDIN HIGHLANDER, who had drawn 3 on the front line, was racing with JAYEES SUPREME, driven by Mr R Reekie, on his immediate inside and MIDNIGHT COWBOY, driven by Mr W Low on the inside of that horse. Behind these two horses were ALEXY, driven by Ms C Negus and STYLISH BABE, driven by Mr J McDermott. Mr Renault pointed out Mr White, shift inwards when not clear, checking JAYEES SUPREME, who in turn caused interference to MIDNIGHT COWBOY and trailing runners ALEXY and STYLISH BABE. Mr Renault also stated that the sulky wheel tyre on Mr White’s horse, ONEDIN HIGHLANDER, was punctured and deflated, in this incident when he crossed into the line of JAYEES SUPREME.

Submissions for Penalty:

Mr Renault informed the Committee that Mr White’s driving statistics were 12 drives last season and 3 so far this season. He also said he had a clear record and credit should be given for his ready admission of the breach. Mr Renault stated that the JCA Penalty Guide provided a starting point for an initial breach of this rule as a 10 drive suspension or a $500 fine. Mr Renault submitted that a fine of around $300 be considered as penalty. Mr Renault said that Mr White had indicated to the Stewards that a fine was preferred as penalty.

Reasons for Penalty:

In determining penalty, the Committee took into account Mr White’s ready admission of the breach and his good record. After taking all factors and penalty submissions into account the Committee determined that a fine was an appropriate penalty in this case. The JCA Penalty Guide recommends a starting point of a $500 fine for a breach of this Rule. In taking the starting point of $500 we were able to afford Mr White a discount of $100 for his admission of the breach and a further $100 for his clear penalty record in regard to this rule. We therefore determined that a fine of $300 was an appropriate penalty in this case.
