Facts:

Following the running of Race 5, the Next Meeting Sunday 24 November Mobile Pace, an information was filed by Stipendiary Steward, Mr S Mulcay, against Open Driver Mr C Thornley alleging that. “You allowed your runner to contact a sulky wheel early in the run home causing your horse to break”.

Mr Thornley had signed the Information admitting the breach and was present at the hearing.

Rule 869(3) (b) provides as follows:

(3) no horseman in any race shall drive:

(b) carelessly

Mr Mulcay with the assistance of Mr Ydgren identified Mr Thornley (Cullenmore) racing 3 wide and 3 back passing the 250 metres. He pointed to Mr Thornley angle his horse to the inside of the tiring Flyingmasterwilliams, contact its wheel and gallop.

Submissions for Penalty:

Mr Mulcay stated Mr Thornley had an exemplary record and deserved credit for it.

Reasons for Penalty:

The JCA penalty Guidelines for the rule provides a $300 fine or a 6-drive suspension.

There are no aggravating factors to consider.

The mitigating factors are Mr Thornley’s outstanding record and admission of the breach.

The Committee having regard for the above factors, considered a fine of $200 as appropriate penalty in this case.
