In these circumstances r 870(5) requires us to relegate LADY MACKENDON to behind KOWHAI SUNRISE.

Facts:
At the conclusion of Race 3, the GOLDEN GIRLS SERIES (HT 3) MOBILE TROT, an information was lodged by Mr Renault under r 870(5) alleging LADY MACKENDON galloped over the finishing line when lapped on by KOWHAI SUNRISE.
Judge’s placings were:
1ST 5 VERY PERSUASIVE
2ND 2 LADY MACKENDON
3RD 9 KOWHAI SUNRISE
The official margin between 2nd and 3rd was ¾ of a length.
Rule 870(5) states:
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.
Miss Butt, the driver of LADY MACKENDON, indicated on the information that she represented the connections of that horse and did not contest the protest.

Mr Renault demonstrated that LADY MACKENDON, when mounting a run in the passing lane, galloped inside the final 50 metres. LADY MACKENDON was lapped on by KOWHAI SUNRISE. He said Miss Butt had immediately taken a hold of LADY MACKENDON in an attempt to run it to its proper gait.
Reasons for Decision:
We are satisfied that LADY MACKENDON galloped with approximately 45 metres to race. The horse, which had not suffered interference from any other runner, continued across the line in a gallop. It was lapped on by KOWHAI SUNRISE at the post.
