The committee was satisfied that Mr Edge had driven carelessly and the charge was found proved. 

Penalty:

Mr Edge is fined $250. 

Facts:

Following the running of Race 1, the BISHOPDALE/BUSH INN TAB & TAVERN HAREWOOD PACE an information was filed by Mr SP Renault alleging Mr A Edge (Scanreco Bay) “...on leaving the final bend he allowed his horse to make contact with the sulky wheel of Tufflittlerooster (M Hallett)...”

Rule 869 (3) (b) states that:

(3) No horseman in any race shall drive

(b) carelessly

Mr Edge admitted the breach but did not appear at the hearing.

Mr Ydgren showed the relevant positions of Scanreco Bay and Tufflittlerooster prior to the home turn. Scanreco Bay was racing at the rear of the field, about 3 widths out, and trailing Tufflittlerooster.

Mr Renault stated that as the field straightened up Mr Edge attempted to shift inwards and in doing so struck the wheel of Tufflittlerooster. Striking the wheel cost Scanreco Bay some ground and the horse rallied well to finish a close up third.

Submissions for Penalty:

Mr Renault stated Mr Edge had admitted the breach at the first opportunity and had a clear record over the past 12 months. He believed the breach was at the mid to lower end of the scale and sought a fine of $300.

Reasons for Penalty:

The committee view this breach as minor and at the low end of the scale. Mr Renault sought a $300 fine but there is no submission from Mr Edge. The committee takes a starting point of $300 and Mr Edge is given credit for his early admission and very good record. A fine at the lower end of the scale is appropriate.
