Decision:

Following the running of race 10 an information was lodged by the Stipendiary Stewards alleging that Ms A Laing (BLEWERIE BOY) drove carelessly with approximately 250 metres to run

Following the running of race 10 an information was lodged by the Stipendiary Stewards alleging that Ms A Laing (BLEWERIE BOY) drove carelessly with approximately 250 metres to run allowing her horse to contact the sulky of LIGEIRA resulting in BLEWERIE BOY breaking. At the outset of the hearing Ms Laing confirmed her admittance of the breach and that she wishes to be present at the hearing.

Mr McIntyre presented the video evidence and asked the Committee to note that it appeared that Ms Laing anticipated a gap between LIGEIRA and the horse on its inside, however, this gap did not occur and BLEWERIE BOY touched the sulky of LIGEIRA and broke. The charge is accordingly found proven.

In respect of penalty Mr McIntyre indicated that the Stipendiary Stewards were seeking either a suspension or a fine. Ms Laing for her part advised that she preferred a suspension and indicated that the horses she would be driving next would be at Addington on 3^rd January and at Rangiora on 5^th January. Mr McIntyre emphasised that Ms Laing’s breach was an error of judgement and at the lower end of the scale.

The Committee, after taking into consideration the submissions of the Informant and Defendant, imposes a suspension from the completion of racing today, 31^st December 2007, until the completion of racing on 5^th January 2008 (an effective 2 days).
