Following the running of Race 2 the Stipendiary Stewards lodged an information alleging a breach of Rule 847 (1) and the Safety Gear Regulations in that Mr Swain (DOREEN JOY) failed to check out with a safety vest resulting in the start being delayed
Following the running of Race 2 the Stipendiary Stewards lodged an information alleging a breach of Rule 847 (1) and the Safety Gear Regulations in that Mr Swain (DOREEN JOY) failed to check out with a safety vest resulting in the start being delayed.
----At the outset of the hearing Mr Swain confirmed his written advice that he admitted the breach of the rule and the Safety Gear Regulations. In explanation he said that he had simply forgotten to put it on. The charge is formally found proven.
----Mr McIntyre, in respect of penalty, advised the Committee that over the holiday racing two drivers had been charged under the relevant rule and each fined the sum of $400.00.
----Mr Swain, for his part, accepted that a monetary penalty only was appropriate but thought that it should be lower than that imposed on previous occasions.
----The Committee, after giving consideration to the submissions of both the Informant and Defendant in respect of penalty, imposes a fine of $400.00 noting that a penalty of that level is appropriate given the issues of safety involved and the delay caused to the start of the race.
