Following the running of race 10 an information was lodged by the Stipendiary Stewards instigating a charge by Mr G A Mathieson alleging a breach of rule 847 (1) and the Safety Gear Regulations



Following the running of race 10 an information was lodged by the Stipendiary Stewards instigating a charge by Mr G A Mathieson alleging a breach of rule 847 (1) and the Safety Gear Regulations.

At the outset of the hearing the Committee noted that Ms Mathieson had indicated in writing that she admitted the breach and did not wish to be present at the hearing.

Mr McIntyre said that prior to race 10 Ms Mathieson had gone out on to the track as the driver of INITIAL THOUGHT and once on the track realised that she did not have her safety vest on. She immediately advised the Starter and received permission to go back to the stalling area and put the safety vest on. The charge is accordingly found proven.

In respect of penalty Mr McIntyre stated he believed the following should be taken into account in arriving at penalty:

  • Ms McIntyre is a Junior Driver
  • --

  • It was her that realised that the safety vest was not in place, and
  • --

    --

  • That her and her employer, the trainer of INITIAL THOUGHT had a busy day
  • --

The Committee noted that the normal penalty for such an offence is in the vicinity of $400.00 but after giving Ms Mathieson credit for the matters outlined by Mr McIntyre imposes a penalty of $200.00.
