Rule 869 (4) : Following the running of race number 7 the Stipendiary Stewards lodged an information against Mr T McMillan (Doctor Zeus) alleging that he drove in a manner causing or likely to cause interference when shifting The Duke of York (T Woodward) down on to Macy Belle (T Chmiel) resulting in Macy Belle striking a pylon and breaking.
Rule 869 (4) : Following the running of race number 7 the Stipendiary Stewards lodged an information against Mr T McMillan (Doctor Zeus) alleging that he drove in a manner causing or likely to cause interference when shifting The Duke of York (T Woodward) down on to Macy Belle (T Chmiel) resulting in Macy Belle striking a pylon and breaking.

At the outset of the hearing it was noted that Mr McMillan had in writing admitted the breach and indicated that he did not wish to be present at the hearing.

The Stipendiary Stewards used video footage of the final 200 metres of the race and pointed out the actions of Mr McMillan which led to the charge. The charge is accordingly found proven.

The Stipendiary Stewards advised the Committee that Mr McMillan had no previous charges under this rule over the last 12 months and sought a monetary penalty.

The Committee after giving consideration to the submissions of the Stipendiary Stewards, Mr McMillan’s record and his early guilty plea agrees that a fine only is warranted and Mr McMillan is, accordingly, fined the sum of $200.00.
