Facts:

Following the running of Race 5, the Bishopdale & Bush Inn TAB/Tavern Harewood Tavern Mobile Pace, an Information was filed by Stipendiary Steward Mr S Renault against Advanced Amateur Horseman Mr R Reekie, alleging a breach of Rule 869(2)(a) in that he used his whip in an excessive manner over the concluding stages.

Rule 869(2)(a) reads as follows:

“(2) No horseman shall during any race:-

(a) Use his whip in an unnecessary, excessive or improper manner.”

Mr Reekie had endorsed the Information that this breach of the Rules was admitted. Mr Reekie had also advised the Stewards that he did not wish to be present at the hearing.

Mr Renault gave evidence and showed video replays of Mr Reekie driving COMENCHE, when in 2nd place and approaching the 200m, use his whip on 29-30 occasions over the final stages, which is clearly in breach of the whip guidelines.

Mr Renault submitted that there were a couple of pauses during Mr Reekie’s use of the whip and that he had used the whip with his hand on the rein as well. He also stated that the force used was minimal but that it was the sheer number of strikes that brought about this charge.

Submissions for Penalty:

Mr Renault stated that Mr Reekie had a clear record in regard to this rule. He also stated that Mr Reekie had admitted the breach at the first opportunity. He submitted that a fine of $200 be considered in this case.

Reasons for Penalty:

In determining penalty we took the JCA Penalty Guide recommendation of $300 for a breach of this Rule as a starting point. We were able to give Mr Reekie credit for his clear record for which we were able to give him a discount of $50. We were also able to give Mr Reekie a further discount of $50 for his ready admission of the breach. We therefore determined that an appropriate penalty on this occasion was a fine of $200.
