DECISION & REASON

Following the running of Race 1 the Stipendiary Stewards lodged an information instigating a Charge against A B Ford under Rule 869 [6] (b) (c) alleging that he moved outwards with approximately 1400 metres to run forcing Zsa Zsa (A Tomlinson to race wider on the track thereby breaching the "Push Out Rule". At the commencement of the Hearing Mr Ford confirmed that he admitted the breach but wish to be heard in respect penalty and mitigating circumstance.

The Stipendiary Stewards showed the video record of the incident which confirmed that the admitted breach occurred with approximately 400 metres of the race to run. The video evidence showed Mr Ford racing two out and moving forward and outwards when lapped on by Zsa Zsa.

The Committee finds the Charge proven. Submissions were made by the Stipendiary Stewards as to penalty. The recommendation was that the normal range of monetary penalty should be imposed on this occasion. Mr Ford said in mitigation that he was simply following the horse in front. He accepted however that his actions were a breach of the Rule.
----The Committee, after giving consideration to the submissions of the Stipendiary Stewards and Mr Ford, imposes a penalty of $200.00.
