2004/09/19
Race Number:
Race 1

Following the running of race one an information was lodged by Mrs Williams instigating a protest under Rule 869(8).
--
DECISION & REASON
----Following the running of race one an information was lodged by Mrs Williams instigating a protest under Rule 869(8). It was alleged that horse 5 Wonder Woman placed 2nd by the judge had interfered at the start of the race with horse 6 placed 9th by the judge and horse no. 7 Socket's Rocket placed 10th by the judge.
----Mrs Williams in summary said that at the start of the race Wonder Woman went sideways colliding into Capulet (P. Young) which in turn inconvenienced Socket's Rocket causing both horses to break and lose ground with the horses finishing second to last and last respectively.
----Mr McIntyre (assistant stipendary steward) stated that he was positioned in the observation box at the top of the home straight immediately behind the starting point and that he observed Wonder Woman go sideways quickly at the start causing Capulet to break, move out and collide with Socket's Rocket with both horses losing ground. It was noted from the video evidence that Capulet as a result of the interference had its knee boot torn off.
----Mr P. Young (Capulet) stated that at the start of the race his horse was standing just slightly back from the tape beside Wonder Woman who was on the inside of his horse. He further stated that Wonder Woman moved out sharply, approximately 2-3 widths, taking his horse's ground causing it to break and lose a knee boot in The Melee. He also said that as a result of the interference Socket's Rocket which was on his horse immediately broke and lost ground. Mr M. Prendergast (Socket's Rocket) said in evidence that at the start of the race his horse was interfered with by Capulet and as a result lost considerable ground and losing all chance in the race. Mr Larter (the trainer of Wonder Woman) said that at the start there was delay due to the horse on the inside of Wonder Woman, Light Flyer, becoming fractious and that as a result his horse stood wide of Light Flyer. He did however accept that his horse ran out and interfered with C--- who in turn interfered with Socket's Rocket, however, in his view the interference was not sufficient to bring about relegation. Mr Chimiel (the driver of Wonder Woman) gave similar evidence as Mr Larter.
----The Committee, as was acknowledged by all parties present at the hearing, finds that interference did take place and as a result of that interference Capulet and Socket's Rocket lost considerable ground and therefore were denied the opportunity of attempting to finish in a better position than each of the horses did. The Committee has the discretion in this matter, however, after taking into account the evidence given on behalf of the informant including the video evidence which was viewed by the Committee, the Committee is of the view that the proper outcome is for Wonder Woman to be relegated to a place immediately behind the two horses interfered with. Accordingly, Wonder Woman is now placed 10th. The stake bearing places now read:
------Ali's Home ? First
--Copper N Gold ? Second
--Tamai Fella ? Third
--Turbo Express ? Fourth
--Impulse Fella - Fifth
