Decision:

Following the running of Race 4, the Equine Veterinary Services Discretionary Handicap Trot, an information was filed by Stipendiary Steward Mr N. G. McIntyre alleging a breach of Rule 870(3) and the “Breaking Horses” Regulation by POPZ DELIGHT (10) driven by Mr D. J. Dunn.



Following the running of Race 4, the Equine Veterinary Services Discretionary Handicap Trot, an information was filed by Stipendiary Steward Mr N. G. McIntyre alleging a breach of Rule 870(3) and the “Breaking Horses” Regulation by POPZ DELIGHT (10) driven by Mr D. J. Dunn.

Mr Dunn advised that he would represent the interests of the trainer and owner of  POPZ DELIGHT.  Mr Dunn also agreed that he understood the nature of the protest, the Rule it was brought under, and the “Breaking Horses” Regulation.

The Information reads as follows.

--

“This is a protest against horse number 10 placed 4th by the Judge on the grounds of breaking from its gait over the final stages.”

--

Rule 870(3) provides as follows.

--

“(3) Any horse which breaks from its gait shall promptly regain its gait.”

--

Clause (b) of the “Breaking Horses” Regulation provides as follows.

--

“(b)  Any horse which breaks from its gait within the final 200 metres of any race and  continues on in the break for a distance of 50 metres or greater, shall be deemed  to be in breach of Rule 870(3) in that it has failed to promptly regain its proper  gait.”

 Stipendiary Steward Mr Ydgren used video coverage to show that POPZ DELIGHT went into a break at about the 50 metre mark.  It was the Stipendiary Steward’s case that the horse broke before reaching the 50 metre mark and that it should therefore be disqualified.

Mr Dunn gave evidence that it was not possible to say exactly where his horse had gone into a break.  He said that his horse had trotted roughly for two strides before going into a break.  Mr Dunn also used video coverage to illustrate his evidence.

After hearing the evidence we adjourned to consider our decision.  We were satisfied that POPZ DELIGHT broke from its gait at about the 50 metre mark.  The video coverage from the various angles was not clear enough to show that POPZ DELIGHT had in fact broken from its gait before reaching the 50 metre mark.  We therefore decided that the protest should be dismissed.

On returning to the Enquiry Room we advised the parties of our decision.
